Welcome to MyAcademyVault. By accessing or using our website, mobile application, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and our Cookie Policy. If you are under 18, you must have your parent or guardian's permission to use the Service. If you are under 13, a parent or guardian must create and manage your account.

2. Description of Service

MyAcademyVault provides an AI-powered educational tutoring platform that includes:

  • Conversational AI tutoring across multiple subjects
  • Photo-based homework help via OCR technology
  • AI-generated practice problems with feedback
  • Progress tracking and analytics
  • Parent and teacher dashboards for monitoring student activity
  • Study plan generation and printable worksheets

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorized access to your account.
  • One person may not maintain more than one account of the same role type.

4. Acceptable Use

You agree NOT to:

  • Use the Service to generate complete assignments to submit as your own work without learning from the process
  • Upload harmful, inappropriate, or illegal content
  • Attempt to bypass usage limits or security measures
  • Share your account credentials with others
  • Use automated tools to access the Service (scraping, bots, etc.)
  • Use the Service for any purpose other than educational learning
  • Harass, abuse, or harm other users
  • Reverse engineer or attempt to extract the AI prompts or algorithms

5. AI-Generated Content Disclaimer

The AI tutor is a learning aid, not a substitute for professional education.

  • AI responses may occasionally contain errors or inaccuracies.
  • Content is generated by artificial intelligence and should be verified.
  • We do not guarantee that AI responses are correct, complete, or suitable for any particular purpose.
  • The Service is not a replacement for teacher instruction or professional tutoring.
  • Users should always verify important information with authoritative sources.

6. Educational Disclaimer

MyAcademyVault is a supplementary educational tool and is not a replacement for formal education, classroom instruction, or professional tutoring.

  • There is no guarantee, express or implied, that using MyAcademyVault will result in improved academic performance, higher grades, better test scores, or any specific educational outcome.
  • Academic results vary significantly based on individual effort, prior knowledge, learning style, consistency of use, and many other factors beyond our control.
  • The AI tutor provides educational support and supplementary learning assistance but is not a licensed teacher, certified tutor, or credentialed educational professional. AI-generated guidance should not be relied upon as a sole source of instruction.
  • Parents and guardians are responsible for supervising their children's use of the Service and for making educational decisions on their behalf. MyAcademyVault does not assume any responsibility for parental oversight of a child's learning activities.
  • Users are encouraged to use MyAcademyVault alongside, not in place of, their regular coursework, teacher instruction, and other educational resources.

7. Subscription and Billing

7.1 Free Trial

Every new account receives a 14-day free trial with full access to all features. No credit card is required during the trial period. At the end of the 14-day trial, a paid subscription is required to continue accessing the platform. We reserve the right to modify trial terms with reasonable notice.

7.2 Paid Plans

  • Paid subscriptions are billed monthly through Stripe.
  • Prices are listed on our pricing page and may change with 30 days notice.
  • Subscriptions automatically renew unless canceled before the renewal date.

7.3 Cancellation and Refunds

  • You may cancel your subscription at any time from your account settings.
  • Within the first 30 days of your subscription start date, you will receive a pro-rated refund for the unused portion of your current billing period (monthly plans: remaining days; annual plans: remaining months).
  • After 30 days from your subscription start date, no refunds are issued. You may still cancel at any time and your access will continue until the end of the current billing period.
  • Refunds are processed within 5-10 business days to the original payment method.

7.4 Chargebacks and Payment Disputes

If you have a billing concern, please contact us at [email protected] before initiating a chargeback or dispute with your bank or payment provider. We are committed to resolving billing issues promptly and fairly.

  • Filing a chargeback or payment dispute with your bank or credit card company instead of contacting us first may result in immediate suspension or termination of your account and access to the Service.
  • If a chargeback is filed and later determined to be invalid or fraudulent, you agree to reimburse MyAcademyVault for the disputed amount plus any fees incurred by us as a result of the chargeback (typically $15-$25 per dispute).
  • Accounts terminated due to chargebacks are not eligible for refunds or reinstatement until all outstanding amounts and fees are paid in full.
  • We reserve the right to report fraudulent chargebacks to applicable authorities and collection agencies.
  • By subscribing to the Service, you acknowledge that you will attempt to resolve any billing disputes directly with us before initiating a bank dispute or chargeback.

8. Intellectual Property

  • The Service, including its design, code, AI models, and content, is owned by MyAcademyVault.
  • You retain ownership of content you create (messages, answers, uploads).
  • You grant us a license to use your content to operate and improve the Service.
  • AI-generated content (tutoring responses, practice problems) may be used by you for personal educational purposes.

9. Parent and Teacher Accounts

  • Parents may link to their children's accounts to monitor learning activity.
  • Teachers may create classrooms and view student progress for students who join their classroom.
  • Parents and teachers must only access data for students they are authorized to monitor.
  • Misuse of monitoring capabilities may result in account termination.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

11. Children's Privacy and COPPA Compliance

MyAcademyVault serves students of all ages, including children under 13. We are committed to complying with the Children's Online Privacy Protection Act (COPPA):

  • Children under 13 must have a parent or guardian create and manage their account.
  • We require verifiable parental consent before collecting personal information from children under 13.
  • We collect only the minimum information necessary to provide the educational service.
  • We never share children's personal information with third parties for marketing purposes.
  • Parents may review, modify, or delete their child's data at any time through the Parent Dashboard.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYACADEMYVAULT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use of or inability to use the Service
  • Any errors or inaccuracies in AI-generated content
  • Unauthorized access to your account
  • Any third-party conduct on the Service

13. Indemnification

You agree to indemnify and hold harmless MyAcademyVault from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Termination

  • We may suspend or terminate your account for violation of these Terms.
  • You may delete your account at any time from Settings.
  • Upon termination, your data will be handled per our Privacy Policy.

15. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the state in which MyAcademyVault is incorporated.

16. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect.
